Digital Millennium Copyright Act (DMCA) Policy
The Digital Millennium Copyright Act (DMCA) is a 1998 United States copyright law that implements two 1996 treaties of the World Intellectual Property Organization (WIPO). The DMCA also addresses a number of other significant copyright-related issues. A memorandum briefly summarizing the DMCA may be found here. How to Submit your Complaint

If you are a copyright owner or an agent thereof and believe that any Content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail:

  • The specific identification of copyrighted work claimed to have been infringed.
  • The specific identification of the material that should be removed or access to be disabled.
  • The specific identification that you are the owner, or authorized to act on behalf of the owner of the copyrighted work.
  • Your name, address, telephone number and email address.
    The following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled." Under Section 512(f) any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
  • A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or the federal district courts located in Washington County, Wisconsin if your address is outside of the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your signature: typing your full name in a document will act as your digital signature.

The fastest way to get a response is to send an email to info@whap.app. You may include an attachment if you like but please also include a plain-text version of your letter in the body of your message.

If you must send your notice by physical mail, you can do so but it will take substantially longer for us to receive and respond to it. Notices we receive via plain-text email have a much faster turnaround than PDF attachments or physical mail. If you wish to mail us your notice, our physical address is listed below, at the bottom of this Policy.

The Designated Agent of Firebit, Inc. will review all valid complaints within ten (10) days of original DMCA notification. If the Designated Agent of Firebit, Inc. notes a breach of copyright, a notification will be submitted to the owner or agent stating the expeditious take down procedure of infringing material, how the material has been removed or disabled and/or any other information regarding the specific copyright case.

How to Submit a Counter-Notification
If you believe you are the wrongful subject of a DMCA notification, you may file a counter-notification with Firebit, Inc. by providing the following information to the Designated Agent at the address below:

  • The specific URLs of material that Firebit, Inc. has removed or to which Firebit, Inc. has disabled access.
  • Your name, address, telephone number and email address.
  • A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or the federal district courts located in Washington County, West Bend if your address is outside of the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • The following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled." Under Section 512(f) any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
  • Your signature: typing your full name in a document will act as your digital signature.

Upon receipt of a valid counter-identification, Firebit, Inc. will forward it to Notifying Party who submitted the original DMCA notification. The original Notifying Party (or the copyright holder he or she represents) will then have ten (10) days to notify us that he or she has filed legal action relating to the allegedly infringing material. If Firebit, Inc. does not receive any such notification within ten (10) days, we may restore the material to the Services.

Infringements of the DMCA
In the case of multiple infringements where copyrighted work has been reported, the Designated Agent, on behalf of Firebit, Inc., may seek to remove the individual(s) or agent(s) access to the site and review legal jurisdiction of a Federal District Court or judicial district in which the individual(s) or agent(s) address is located (or the federal district courts located in Washington County, West Bend). This party or parties may be subject to liability for damages.
